Terms of Use

By selecting the checkbox labeled "I HAVE READ AND AGREE WITH THE TERMS OF USE," you (referred to as the “INVENTOR”) confirm that you have read, understood, and agreed to the following "Terms of Use" regarding the submission of your video to Better Managed Toys LLC (herein referred to as “BMT”):

In exchange for valuable consideration, BMT agrees to accept your Product Concept video (“VIDEO”) for the exclusive purpose of reviewing and evaluating it. BMT will assess the licensing potential of the Product Concept in the video and agrees to keep the content confidential for a period of one year from the date of submission. BMT will not share the Product Concept video with any third parties (including toy companies and suppliers) without the INVENTOR's explicit consent. However, INVENTOR agrees that BMT may share the Product Concept with its employees, affiliates, consultants, or vendors on a need-to-know basis only.

These Terms of Use do not prevent BMT from using information that:

• Is already publicly available;

• Was already in BMT’s possession prior to this disclosure;

• Was or becomes available through a third party who lawfully possesses such information.

INVENTOR acknowledges that, although BMT strives to maintain the optimal performance of its website (the "SITE"), the use of the SITE is at the INVENTOR’s own risk. The SITE and its materials are provided "as is" and, to the fullest extent allowed by law, without warranties of any kind, either expressed or implied. There is no guarantee that the SITE is suitable for any particular purpose. SITE functions, including submission functionality, are not guaranteed to be uninterrupted, secure, or error-free; any defects may not be corrected; and the SITE is not warranted to be free of viruses or other harmful elements, nor to be accurate, reliable, or error-free.

BMT, its parent company, affiliates, and their respective agents, employees, directors, officers, and owners will not be held liable for any damages arising directly or indirectly from delays, inaccuracies, failures, errors, omissions, interruptions, deletions, defects, viruses, or communication issues, or for any theft, destruction, loss, damage, or unauthorized access to or publication of your computer system, network, or VIDEO. By submitting a VIDEO, the INVENTOR assumes all risks associated with any potential loss, theft, destruction, damage, or unauthorized access to or disclosure of the video.

These Terms of Use are governed by the laws of the State of Illinois, without regard to any conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of the State of Illinois or, where applicable, the United States District Court for the District of Cook County for any disputes, actions, or proceedings that arise in connection with these Terms of Use or your use or non-use of the SITE. You further agree to waive any right to a trial by jury in connection with any such dispute, action, or proceeding.

INVENTOR confirms that they are at least eighteen (18) years of age and that they have reviewed and understood BMT’s Privacy Policy.
